Terms of Service

These Terms of Service (“Terms”) govern your use of the Nyber VPN apps, website, and services (“the Service”), which are provided by DEL TECH, a sole proprietorship registered in Ontario, Canada (BIN 1001513388). By creating an account or using the Service, you agree to these Terms.

Eligibility and accounts

You must be at least the age of majority in your jurisdiction to use the Service. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

Acceptable use

You agree not to use the Service to break the law or to harm others. Prohibited uses include, without limitation:

• illegal activity or distribution of unlawful material;
• attacking, scanning, or disrupting networks or systems you do not own or have permission to test;
• sending spam or distributing malware;
• infringing the intellectual property or privacy rights of others;
• reselling or sharing the Service in a way not permitted by your plan.

We may suspend or terminate accounts that violate these rules in order to protect the Service and other users.

Subscriptions and billing

Paid plans are billed in advance for the period you select. Unless otherwise stated, subscriptions renew automatically until cancelled. You can cancel at any time, and cancellation takes effect at the end of the current billing period. Prices and plans may change; we will give notice of changes before they apply to a renewal.

Refunds

Where a refund policy or trial is offered, its terms are presented at the time of purchase. Purchases made through a third-party app store are also subject to that store’s refund policies.

Service availability

We work to keep the Service reliable but do not guarantee that it will be uninterrupted or error-free. We may modify, suspend, or discontinue parts of the Service, and we may perform maintenance that temporarily limits availability.

Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we handle your information.

Disclaimer and limitation of liability

The Service is provided “as is” without warranties of any kind, to the maximum extent permitted by law. To the extent permitted by law, DEL TECH will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the Service is limited to the amount you paid for it in the twelve months before the claim.

Governing law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable there, without regard to conflict-of-laws rules.

Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted, as shown by the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
